Rental Agreement

All guests must agree to and sign a copy of our rental agreement in order to finalize their booking. A link will be sent to you after you've submitted your booking request.

MOMENT GETAWAYS RENTAL AGREEMENT

Bookings are not complete until this Rental Agreement is formally signed. A digital copy will be sent via email after booking has been completed and is required to be signed within 48 hours to finalize booking. If Host does not receive a signed copy of the Rental Agreement the reservation may be canceled and refunds will be processed as per our refund policy. A $50 administration fee will apply.

 

THE PARTIES. This Short-Term Rental Agreement (“Agreement”) made on {{reservation_date}} between the following:

Host: {{host_name}} (“Host”).

THE PREMISES. The Host agrees to lease the described property below to the Guest, and the Guest agrees to rent from the Host:

RENTAL TERM. The Guest shall be allowed to occupy the Premises starting {{checkin_date}} from {{checkin_time}} and ending {{checkout_date}} at {{checkout_time}} (“Lease Term”).

Check-in and check-out times are strictly enforced to allow for the thorough inspection, cleaning, and maintenance of the premises. A $100 fee may be charged for unexpected early arrivals or late check-outs. 

ID VERIFICATION & SECURITY DEPOSIT.

Important: We are committed to protecting our properties and keeping up-to-date with short-term rental regulations, which is why you will be asked to complete our independent verification.

Please note: Before your booking is confirmed, you will need to verify your details with us to complete your booking.

You will also be given the choice between paying a refundable $500 deposit or buying a non-refundable $35 damage waiver. We suggest you buy the damage waiver as this protects you in case you cause accidental damage during a booking.

CANCELLATION & REFUND POLICY.

To receive a full refund, guest must cancel at least 30 days before check-in. Credit card processing fees will not be reimbursed.

If guest cancels between 7 and 30 days before check-in, a 50% refund will be issued. Credit card processing fees will not be reimbursed. 

If guest cancels less than 7 days before check-in, no refund will be issued.

Guest may also receive a full refund if they cancel within 48 hours of booking, if the cancellation occurs at least 14 days before check-in.

OCCUPANTS. The total number of individuals staying on the Premises during the Lease Term shall be a total of {{number_of_guests}} guests.

If more than the authorized number of guests listed above are found on the Premises, this Agreement will be subject to termination by the Host. Additional guests may be permitted at the sole discretion of the Host. An Additional fee may apply. 

PETS. The Host does not allow pets: There are no pets allowed on the Premises. If the Guest is found to have pets on the Premises, this Agreement and any Security Deposit shall be forfeited.

QUIET HOURS. Quiet hours begin at 10:00 PM each night and continue until 8:00 AM. Quiet hours consist of no music and keeping all audio at a minimum level out of respect for the surrounding residents and by-laws.

PEACEFUL ENJOYMENT.  The Guest, along with neighbors, shall enjoy each other’s company in a quiet and respectful manner to each other’s enjoyment. The Guest is expected to behave in a civilized manner and shall be good neighbors with any residents of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement.

BOOKING FEES. The Guest shall pay the Host the amount as detailed during the booking process.

UTILITIES. The Host shall be responsible for all utilities and services to the Premises EXCEPT for the following: None.

SMOKING POLICY. Smoking on the Premises is prohibited.

SUBLETTING. The guest does not have the right to sublet the Premises.

INSPECTION. The Host, its agent, or contractors shall be allowed access to the Premises at any reasonable time during the Rental Period for maintenance or inspection. The Guest shall vacate the Premises at the expiration time and date of this agreement.

MAINTENANCE AND REPAIRS. The Guest shall maintain all Premises equipment, furniture, fixtures, fittings and effects in the same state of repair and condition as at the commencement of the rental term. The Guest shall pay for maintenance and repairs should the Premises be left in a lesser condition. The Guest agrees that the Host shall deduct costs of said services from any Security Deposit prior to a refund if Guest causes damage to the Premises or its furnishings. The Guests agree to report immediately details of any significant damage done to the Premises or any of the property, equipment, furniture, fittings and effects. 

TRASH. The Guests shall dispose of all waste material generated during the Lease Term under the strict instruction and direction of the Host.

OPEN FIRES. The Guests shall follow the Host's open fire protocols and local by-laws at all times of the Rental Term. Open Fires are not guaranteed due to local by-laws and safety regulations. The Host will provide status updates 3 days prior to check-in. Instructions will be provided within the premises.

FIREWORKS. Fireworks are not permitted at any time on the premises. 

ACCESS TO PREMISES. The Guest will be given a lock combination or keypad code for the front door three days prior to the rental period. If leaving the Premises, the Guest agrees to lock all doors and windows before leaving. The Guest agrees to refrain from accessing areas and/or buildings not permitted by the Host.

SECURITY CAMERAS. For security reasons, the Premises have cameras that monitor the exterior of the Premises. The Guest agrees not to obscure or disable the cameras at any time. 

ILLEGAL ACTIVITY. The Guest shall use the Premises for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement with no refund. 

GOOD WORKING ORDER. The Host makes every effort to maintain the Premises in good working order. If necessary, the Host will attempt to replace, fix or schedule maintenance as soon as an issue is reported. In rural areas, items and services may take longer than expected. No discounts or refunds will be given for equipment or appliance failure, internet, utilities, technical difficulties or disruptions to enjoyment of the Premises due to power outages or other occurrences outside of the Host's control.

POSSESSIONS. Any personal items or possessions that are left on the Premises are not the responsibility of the Host. The Host shall make every reasonable effort to return the item to the Guest. If claims are not made within two (2) days the Host shall be able to keep such items to sell, dispose or for personal use.

ACCURACY. The Host has made every effort to ensure that all information on all websites is correct at the time of publication or at the time of inspection of the Premises. This information made by the Host is made in good faith and the Host cannot be held liable in any way for minor changes.

RIGHT TO REFUSE. The Host has the right to refuse entry to the Premises to all or any persons, without refund, whom the Host considers to be in material breach of these Terms and Conditions. Such breaches include conduct in an offensive or disorderly manner. In such an event, the Host will not be liable for any payment to the Guest and will retain all monies paid.

GUEST ACKNOWLEDGMENT. The Guest acknowledges that they are entering into the Guest Agreement on their own behalf and are not acting as agent and/or representative on behalf of any other person and/or additional guest not listed in the Guest Agreement. The Guest further agrees that they shall not assign or sublet the Premises. 

HOST’S LIABILITY. The Guest represents, warrants, and acknowledges that they will use the Premises and its facilities at their own risk and indemnify and save the Host and/or its agents harmless from any personal injury, sickness, death, loss or damage, however caused, to person or property, his/her family or guests, during or after the time of occupancy. Further, the Guest accepts full responsibility for the use of any recreational equipment, such as hot tubs, pool, fire pit, etc., and agrees to pay for any repairs or replacement of said equipment, other than normal wear. 

ATTORNEY’S FEES. The Guest agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Host enforcing this agreement.

USE OF PREMISES. The Guest shall use the Premises for residential use only. The Guest is not authorized to sell products or services on the Premises or conduct any commercial activity.

GOVERNING LAW. If government laws or regulations prevent the Host from providing the rental accommodation outlined in this agreement, the Host has the right to cancel this agreement for this booking. In the event of a cancellation by the Host, a refund will be processed for all monies received from the Guest including rental charges and security deposit.

UNENFORCEABLE. If any portion of this agreement is deemed unenforceable, the rest of the agreement shall stand as written. 

 

I, on behalf of myself and other authorized Guests, shall be responsible in law for strict compliance with the provisions of this Agreement by all persons, directly and indirectly, occupying, attending at, or otherwise in any way using the Premises during, or in any way relating to, the Rental Period. I hereby acknowledge that I/ We have read and understand all conditions of the Guest Agreement and agree to the Terms and Conditions. I/We further acknowledge that this offer is only valid for 2 business days from the date that this agreement is first sent, after which time it becomes null and void if not fully executed.
